General Terms and Conditions of Sale - KIDO Corner

1. Purpose of the contract:

• These terms and conditions govern the online sale of baby and children's clothing by KIDO Corner via its online store.

2. Products:

• Product descriptions are available on the website. Images are for illustrative purposes only and may differ slightly from the actual product.
• KIDO Corner sells clothing and accessories for babies and children.

3. Commands:

• Every order placed constitutes an offer to purchase. Once the order is placed, the Customer will receive an order confirmation email.
• KIDO Corner reserves the right to accept or refuse an order.

PRODUCT AVAILABILITY

4. Price and payment:

• Prices are shown in € (euros) and include applicable taxes.
• Payment terms are specified during the ordering process.
• As supplier prices are constantly changing, the prices displayed on the site are subject to change at any time.

5. Delivery:

KIDO Corner is not responsible for any loss, theft, or damage to your package during delivery. We are not liable for products lost, stolen, or damaged due to actions or inactions attributable to shipping services, postal services, or other third parties whose actions or inactions are beyond our control once a product leaves our facilities.

• Delivery times are estimated at 2 to 4 working days and may vary depending on the destination.
• KIDO Corner is not responsible for delivery delays due to circumstances beyond its control.
• If you receive an item that is not in perfect condition, please contact us immediately with pictures of the defects within 7 days of receipt and it must be in its original condition, unworn and unwashed.
• We are unable to redirect the shipment to another address or cancel the order once it has been shipped.
• It is the customer's responsibility to locate their package if they provided an incorrect delivery address. Please note that if your order is returned to us, you will be responsible for return and reshipping costs. If you no longer wish to have your order reshipped, you will receive a refund, less the initial shipping and reshipping fees.
  Unfortunately, we are not responsible for packages damaged during transit or lost after delivery. It is the customer's responsibility to track their package and monitor its condition.
• Free delivery is offered for orders over €49 within France only. For other areas, shipping costs are charged to the customer regardless of the order amount. The free delivery offer for orders over €49 is subject to change and is not guaranteed.

6. Returns and exchanges:

• In accordance with the provisions of the Consumer Code, article L.221-16, the buyer has a period of 14 days (withdrawal period) from the date of delivery of his order, to return any item which does not suit him and request an exchange or refund without penalty, with the exception of the return costs which remain the responsibility of the buyer.

Returns must be made in their original condition and complete (packaging, accessories, shoe box, plastic bags, etc.). Consequently, returns of washed and/or worn clothing, incomplete items, and damaged boxes will be refused.

• After this period of 14 (fourteen days) the return will be refused.
• Refunds in the event of exercising the right of withdrawal will be made using the same payment method as that used by the Customer for the initial transaction.

In the event of order cancellation: the customer must use the cancellation form shown below:

KIDO Corner suggests that the Customer return their products via a tracked or insured shipping method. This ensures that in case of damage or loss, the merchandise will be compensated up to its actual market value by the shipping company. The Customer always returns the products at their own risk. The Customer must retain all proof of return. Return shipping costs are the Customer's responsibility, and the Customer retains the freedom to choose the shipping method.

7. Product quality:

• KIDO Corner guarantees product quality in accordance with industry standards.

8. Guarantees
In accordance with Article 4 of Decree No. 78-464 of March 24, 1978, the provisions herein cannot deprive the Client of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of hidden defects in the thing sold.

Complaint / Mediation

In the event of a dispute between the Client and KIDO Corner, the parties agree to attempt mediation before taking legal action. In accordance with applicable legal provisions, the mediator will be "The Online Meditation Institute (iMel)," an independent and impartial mediation body.

The Client can contact the mediator on the following website: https://imel-mediation.fr/. The mediator will facilitate communication between the parties in order to reach an amicable resolution of the dispute.

It is important to note that mediation is a voluntary process and that the parties retain the right to take legal action if mediation does not lead to a satisfactory resolution of the dispute.
